RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF WARNING: BY CHECKING THE BOX BELOW, YOU WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION. PLEASE READ CAREFULLY!

In consideration of Lohn Home Fragrances (“LOHN”) permitting the individual named below (“Guest”) to participate in LOHN’s candle- making class, including, without limitation, candle construction activities, use of manual and powered tools and machines and other related activities (collectively, the “Activities”), and for other good and valuable consideration, I know RISK AND INDEMNITY AGREEMENT

I AM AWARE AND UNDERSTAND THAT THE ACTIVITIES ARE INHERENTLY RISKY AND INVOLVE DANGERS AND HAZARDS, INCLUDING BUT NOT LIMITED TO THE RISK OF FIRE, BURNS, SERIOUS INJURY, DEATH OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITIES. I FREELY ACCEPT AND FULLY ASSUME OF THE RISKS, DANGERS AND HAZARDS INVOLVED, BOTH KNOWN AND UNKNOWN TO ME, AND THE POSSIBILITY OF INJURY, DEATH AND/OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF LOHN OR OTHERWISE.

  1. Waiver and Release. I hereby, for myself, my heirs, successors, executors, administrators and personal representatives, waive, release and forever discharge LOHN, its affiliates and its and their respective directors, officers, employees, agents, representatives, members, successors and assigns (collectively, the “Releases“) from and against any and all claims or causes of action of any kind arising out of or attributable to my (i) participation in any of the Activities and/or (ii) my use of any candle or other product created or rendered during my participation in the Activities a (collectively, the “Products“), due to any cause whatsoever, including without limitation, the negligence of LOHN or any other Release, and whether they be bodily, moral or material in including, without limitation, physical or psychological injury, illness, paralysis, death, economical or emotional loss) and whether as a direct or indirect result of my participation in any of the Activities or use of the Products. I acknowledge and agree that I am responsible for determining the quality, fitness for the intended purpose, safety and proper use of the Products and for determining what safety precautions are necessary when using the Products. I acknowledge that LOHN makes no representations, conditions or warranties as to the quality, safety, maintenance or use of the Products.
  2. Responsibility for Damage. In the event that any damage to equipment or facilities of LOHN occurs as a result of my wilful actions, neglect or recklessness, I will be liable for any and all costs associated with any actions of neglect or recklessness.
  3. Consumption of Alcohol. I understand that LOHN may make available or permit the consumption of alcohol by participants of the Activities who are of legal drinking age. I acknowledge and agree that any decision by me to consume alcohol is voluntary and that the consumption of alcohol may increase the risks associated with participation in the Activities. I hereby release and forever discharge LOHN from any claim whatsoever that arises or may hereafter arise as a result of my decision to consume alcohol.
  4. Indemnity. I agree to indemnify and hold harmless LOHN and the other Releases from and against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including legal fees and any what related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If LOHN or any other Release incurs any of these types of expenses, l agree to reimburse LOHN or such other Release.
  5. Insurance. I understand that neither LOHN nor any of the other Releases assumes any responsibility for or any obligation to provide any financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage. I understand and acknowledge that LOHN does not carry or maintain, and expressly disclaims responsibility for providing, any health, medical, or disability insurance coverage for me.
  6. Medical Treatment. Except as otherwise agreed to by LOHN in writing, I hereby release and forever discharge LOHN from any claim whatsoever that arises or may hereafter arise on account of any first- aid treatment or other medical services rendered in connection with any emergency/incident during my time with LOHN or for LOHN 
  7. Photographic Release. I understand that photographs and/or audio-visual recordings may be recorded and may contain my recognizable image. I grant LOHN permission to use, reproduce, publish, transmit, distribute, broadcast and display any photograph and/or audio-visual recording that contain my image and/or voice in any LOHN publication, multimedia production, display, advertisement and/or on LOHN’s website and social media accounts without further notice or my approval. I understand that any photograph or audio-visual recordings that contain my image and/or voice shall constitute the property of LOHN and I waive any right to inspect or approve their use. I acknowledge that I am not entitled to and shall not seek any compensation, fees or royalties from any photograph and/or audio-visual recordings that contain my image and/or voice.

I affirm that I am of the age of 18 years or older; that I do not have any health conditions that prevent me from participating in the Activities and that I am freely signing this document. I understand and agree that this Agreement is intended to be as broad and inclusive as permitted by the laws of Lagos State, Nigeria, and that this Agreement shall be governed by and interpreted in accordance with the laws of this Province. I agree that in the event that any clause or provision of this Agreement shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Agreement, which shall continue to be enforceable. I certify that I have read this

Agreement in its entirety, that I fully understand its content and this Agreement cannot be modified orally. I am aware that this is a release of liability and a contract.

By Checking the box below, I express my understanding and intent to enter into this Agreement willingly and voluntarily. I acknowledge that I have had the opportunity to carefully review this document and ask questions before signing. I acknowledge that this is a binding legal document and that by signing this document I am waiving my right to sue LOHN; I am giving up a right to a future claim against LOHN and that LOHN will rely on this document in the event of any claim I may seek to bring against LOHN.
